These Terms & Conditions (“Terms”) govern your access to and use of the Future Stacks website at https://devfood.com and the Devfood online ordering platform (the “Service”). By using the website or subscribing to the Service, you agree to these Terms.

1. The Service

Devfood is a white-label online ordering platform that provides branded customer, restaurant, and driver apps and an administrative dashboard. The specific features available to you depend on your chosen plan and any add-ons.

2. Accounts & Eligibility

• You must provide accurate information and keep your account credentials secure.
• You are responsible for all activity that occurs under your account and outlets.
• You must be authorized to operate the food business you register on the Service.

3. Subscriptions, Fees & Billing

• The Service is charged per location, per month, at the rates published on our pricing page.
• A one-time setup fee applies to monthly billing and is waived on annual prepayment; optional add-ons are billed as described at purchase.
• Subscriptions renew for the same term unless cancelled before the renewal date.
• Third-party costs — such as app store developer accounts, mapping APIs, SMS/OTP, and payment-gateway transaction fees — are billed by those providers and are your responsibility.

Refunds, where applicable, are governed by our Refund Policy.

4. Your Responsibilities

• You are responsible for your menu, pricing, content, fulfilment, food safety, and compliance with all laws applicable to your business.
• You must obtain any consents required to contact your customers and process their data.
• You must not use the Service for any unlawful, fraudulent, or abusive purpose.

5. Intellectual Property

The Devfood platform, software, and website — excluding your own brand assets and content — are owned by Future Stacks and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your brand, menu, and customer data.

6. Data & Privacy

Our handling of personal data is described in our Privacy Policy. You remain the controller of your customers’ data and are responsible for using it lawfully.

7. Third-Party Services

The Service integrates with third-party providers (e.g. payment gateways, mapping, messaging). Your use of those services is subject to their terms, and we are not responsible for their availability or actions.

8. Service Availability

We work to keep the Service available and performant, but we do not guarantee uninterrupted operation. We may perform maintenance, updates, and improvements that temporarily affect availability.

9. Suspension & Termination

You may cancel your subscription in line with your plan. We may suspend or terminate access for non-payment, a breach of these Terms, or unlawful use. On termination, your right to use the Service ends, and you may export your data within a reasonable period.

10. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Future Stacks will not be liable for indirect, incidental, or consequential damages, and our total liability will not exceed the fees you paid for the Service in the three months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a new “Last updated” date, and continued use of the Service constitutes acceptance of the changes.
